1. Introduction

Welcome to Evique ("we", "us", "our"). Evique is an AI-powered outreach and sales automation platform available at https://evique.io, operated from Poland under the trading name Evique Group.

By accessing or using Evique, you agree to be bound by these Terms of Service. If you do not agree, please do not use our service.

2. Service Description

Evique provides a SaaS platform that includes, but is not limited to:

  • AI-powered email drafting and outreach sequence generation
  • Integration with Gmail and Microsoft Outlook via OAuth for sending emails on your behalf
  • Google Calendar integration for scheduling and follow-up automation
  • Contact list management and prospect research tools
  • Analytics and reporting on outreach performance

We reserve the right to modify, suspend, or discontinue any part of the service at any time with reasonable notice.

3. Eligibility and Business Use Only

Evique is intended exclusively for business use, including use by registered companies, agencies, sole proprietors, freelancers, and other professionals acting in the course of their trade, business, craft, or profession.

You must be at least 18 years old to use Evique. By using our service, you represent and warrant that:

  • You meet the age requirement
  • You are acting in a business or professional capacity, not as a consumer
  • You have the legal authority to enter into these Terms on behalf of yourself or the entity you represent

Evique is not designed for, marketed to, or intended for use by consumers as defined under EU Directive 2011/83/EU or analogous consumer protection legislation. Consumer rights of withdrawal under such legislation do not apply to your subscription.

4. Account Registration

To use Evique, you must create an account. You agree to:

  • Provide accurate and complete information during registration
  • Keep your account credentials confidential
  • Notify us immediately of any unauthorised use of your account at support@evique.io
  • Take responsibility for all activity that occurs under your account

We reserve the right to suspend or terminate accounts that provide false information or violate these Terms.

5. Acceptable Use Policy

You agree to use Evique only for lawful purposes. You must NOT use Evique to:

  • Send unsolicited bulk email (spam) in violation of the CAN-SPAM Act, GDPR, Polish law, or any applicable anti-spam legislation
  • Send email to recipients who have not consented to receive commercial communications where such consent is required by law
  • Harass, threaten, defame, or send content that is abusive, discriminatory, or illegal
  • Distribute malware, phishing links, or fraudulent content
  • Scrape data from sources beyond what Evique provides through legitimate APIs
  • Resell, sublicense, or transfer your account access to third parties without our prior written permission
  • Reverse-engineer, decompile, or attempt to extract the source code of Evique
  • Bypass rate limits, daily email caps, or other technical restrictions imposed by the platform
  • Use the service to build a competing product or service
  • Impersonate any person or organisation

Violations of this policy may result in immediate account suspension or termination without refund.

You are solely responsible for compliance with all laws applicable to your use of the service, including laws governing email marketing and data protection in your jurisdiction and the jurisdictions of your recipients.

6. Email Sending and Third-Party Integrations

When you connect your Gmail or Outlook account, you authorise Evique to send emails on your behalf using your credentials. You retain full responsibility for all emails sent through your account, including their content, recipients, and compliance with applicable law.

We are not responsible for the policies or actions of third-party services including Google, Microsoft, Stripe, Anthropic, or any other subprocessor. Your use of these integrations is also subject to their respective terms of service.

7. Subscription and Payment

Evique offers paid subscription plans. By subscribing, you agree to pay the applicable fees as displayed at the time of purchase. All payments are processed securely by Stripe.

  • Subscriptions are billed in advance on a monthly or annual basis
  • You may cancel at any time; your access continues until the end of the current billing period
  • As Evique is a business-only service, no statutory right of withdrawal applies and we do not offer refunds for partial billing periods, unused features, or change of mind
  • Refunds may be granted at our sole discretion in cases of demonstrable technical fault on our side that materially prevented use of the service
  • We reserve the right to change pricing with at least 30 days' prior notice to existing subscribers

If payment fails, we may suspend your account until payment is resolved. Repeated failed payments may result in account termination.

8. Intellectual Property

All content, technology, design, and software comprising the Evique platform are owned by or licensed to Evique and are protected by applicable intellectual property laws.

You retain ownership of any content you upload or create using Evique (such as contact lists, email templates, or campaign data). By using the service, you grant us a limited, non-exclusive, worldwide licence to process this content solely to provide the service to you.

9. Data and Privacy

Your use of Evique is also governed by our Privacy Policy, available at https://evique.io/privacy. By using the service, you consent to the collection and use of your data as described therein.

We process personal data in accordance with the General Data Protection Regulation (GDPR) and applicable Polish data protection law. The supervisory authority for data protection in Poland is the Urząd Ochrony Danych Osobowych (UODO).

10. Limitation of Liability

To the fullest extent permitted by applicable law:

  • Evique is provided "as is" and "as available" without warranties of any kind, express or implied
  • We do not guarantee that the service will be uninterrupted, error-free, or free of harmful components
  • We shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service, including loss of profits, revenue, data, or business opportunities
  • Our total aggregate liability to you for any claim arising under or in connection with these Terms shall not exceed the amount you paid us in the 3 months immediately preceding the event giving rise to the claim

Nothing in these Terms excludes or limits liability for fraud, gross negligence, death or personal injury caused by negligence, or any other liability that cannot be excluded or limited under applicable Polish law.

11. Indemnification

You agree to indemnify, defend, and hold harmless Evique and its founders from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of or relating to your use of the service, your violation of these Terms, your violation of any applicable law, or your violation of any third-party rights.

12. Termination

You may terminate your account at any time by contacting us at support@evique.io or through the account settings.

We may suspend or terminate your access immediately and without notice if you breach these Terms, or at our discretion with reasonable notice in other circumstances. Upon termination, your right to use the service ceases and we may delete your data in accordance with our Privacy Policy.

13. Changes to These Terms

We reserve the right to update these Terms at any time. When we do, we will revise the "Last updated" date at the top of this document and notify you by email at least 14 days before material changes take effect. Continued use of the service after that date constitutes acceptance of the updated Terms.

14. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of Poland, without regard to its conflict of law provisions.

Any disputes arising from or relating to these Terms or your use of Evique shall first be attempted to be resolved by good-faith negotiation. If that fails, disputes shall be subject to the exclusive jurisdiction of the courts competent for the registered seat of Evique in Poland.
